The Short Version

You pay up front. We deliver what the invoice says, in the time frame promised. We will be completely honest about what we can and cannot promise. If something isn't right, reach out to us directly before calling your bank—we will fix it.

1.What These Terms Cover

These terms apply to every purchase from Smooth Turtle (including its owner, successors, and affiliated entities, hereafter "Smooth Turtle," "we," or "us"). Paying an invoice, executing an agreement, or clicking a digital payment button means you accept these terms.

Your invoice defines the specific scope, price, and deliverables for your project. If there is a direct conflict between your invoice and these terms, the invoice takes priority.

2.What You're Buying

Your deliverable is limited strictly to what is written on your invoice—nothing more, nothing less. Any work requested outside that scope requires a new invoice or written change order. We will always notify you and get your explicit approval before performing any billable work.

3.Payment

Payment is due in full before work begins unless your invoice explicitly defines a milestone or deposit schedule. Payments are processed via secure third-party processors (such as PayPal, Stripe, or bank transfer). Smooth Turtle never sees, receives, or stores your credit card or sensitive banking details.

4.Turnaround & Timelines

Delivery timelines are specified on your invoice and counted in business days starting the first business day after payment clears and all necessary onboarding inputs are received. If we are waiting on required assets, access, or approvals from you, the project clock pauses until we receive them.

5.Client Cooperation & Responsive Communication

Certain projects require your active participation—such as providing website logins, access to Google Business Profiles, brand assets, or timely answers to technical questions.

If we request required access or information and do not receive it within 10 business days (and after sending a final written reminder), Smooth Turtle reserves the right to pause the project, bill for work completed to date, or deem the project complete and delivered as-is.

6.Revisions & Corrections

7.Refund Policy

8.Intellectual Property & Ownership

9.Confidentiality & Anonymized Portfolio Rights

We treat your business data, internal metrics, and technical configurations as strictly confidential. We will never share your private business details or feature you by name in marketing without your prior written consent.

Smooth Turtle reserves the right to reference generalized, non-identifying project summaries for portfolio or analytical purposes (e.g., "analyzed search visibility for a Tampa-area home services company").

10.Third-Party Tools & Costs

Hosting fees, domain registrations, API tokens, software subscriptions, and third-party platform costs are your responsibility and billed directly by those providers. Where Smooth Turtle advances third-party fees on your behalf, they will be itemized on your invoice. We are not liable for service outages, policy shifts, or price changes enacted by third-party platforms.

11.Guarantees & Realities of AI / Search Systems

Please read this carefully: Search engines, AI models, and discovery algorithms are owned and operated by independent third parties. Their indexing, ranking, and citation behaviors change constantly and without advance notice.

Smooth Turtle does not and cannot guarantee specific keyword rankings, traffic volumes, AI citation placements, lead counts, or revenue outcomes. What we guarantee is rigorous, competent, data-driven execution and defensible strategic findings. Anyone in this industry promising guaranteed rankings or guaranteed sales is either guessing or lying.

12.Limitation of Liability

To the maximum extent permitted by law, Smooth Turtle's total cumulative liability for any and all claims arising out of or related to our services is capped at the total amount you actually paid us for the specific work in question. Smooth Turtle is not liable for indirect, incidental, special, or consequential damages—including lost revenue, lost profits, or data loss.

13.Dispute Resolution & Chargebacks

If you have an issue or concern, please contact us first at ai@smoothturtle.com or (813) 444-8378. We respond within two business days and will work diligently to resolve the matter fairly.

You agree to contact us to resolve any issues prior to initiating a credit card or payment processor chargeback. Initiating an unauthorized or fraudulent chargeback causes significant administrative harm; should a chargeback be decided in our favor, you agree to reimburse Smooth Turtle for all associated bank fees, legal costs, and administrative time spent resolving the dispute.

14.Governing Law & Jurisdiction

These terms are governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. Any legal action, claim, or proceeding arising under these terms shall be brought exclusively in the courts of Hillsborough County, Florida.

15.Updates to Terms

We may update these terms from time to time. The version of these terms in effect on the date your payment is cleared will govern that specific transaction and engagement.

Let us help make your transition into AI a Smooth one.
